Terms

Terms of service

Draft for review by a solicitor before launch. Based on British Association of Removers model terms, the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 and the Torts (Interference with Goods) Act 1977.

1. Who we are

BoxSpeed is a trading name of [Company name] Ltd, company number [number], registered office [address], VAT number [number] ("we", "us"). We provide collection, storage and redelivery of goods for customers in mainland Great Britain.

2. The service

We collect goods on the fixed weekly day for your postcode area, store them at our premises in Oxfordshire, and redeliver them on the fixed day for the delivery address. Dates are confirmed at booking subject to capacity. We may move a collection or delivery to the following week where a route is full or a vehicle is unavailable, and will tell you as soon as we know.

3. Prices and payment

Prices are as published at boxspeed.co.uk/pricing on the day you book, inclusive of VAT. The collection fee and the first month are paid at booking; storage is then billed monthly in advance to the card on file from the collection date. Prepaid plans are non-refundable after collection except under clause 9. Return fees are paid when a return is booked.

4. What you may store

You confirm that your goods do not include any prohibited item listed at boxspeed.co.uk/prohibited-items, that boxes are sealed and under 25 kg, and that you own the goods or are authorised to store them.

5. Our liability and cover

Our liability for loss or damage is limited to £100 per item unless higher cover was purchased or a higher value declared and accepted in writing before collection. We are not liable for damage to the contents of boxes we did not pack, for items on the prohibited list, for pre-existing damage recorded at collection, or for loss caused by events beyond our reasonable control. Nothing in these terms limits liability for death, personal injury or fraud.

6. Access, inventory and returns

Goods are stored in sealed crates and containers; you cannot visit the warehouse. Your online inventory shows what we hold. Returns are booked online to any address in an area we serve, on that area's day. A part return is charged as a return.

7. Cancellation and cooling-off

Under the Consumer Contracts Regulations you may cancel within 14 days of booking without charge. By booking a collection date inside that period you ask us to start the service before the cooling-off period ends, and if you cancel after collection you pay for the service supplied to that point. Cancellations of a collection with fewer than three days' notice may be charged the collection fee.

8. Non-payment and uncollected goods

If a monthly payment fails we will tell you and retry over 14 days. If storage remains unpaid for 30 days we may suspend returns. If goods remain unpaid for and uncollected we will give written notice under the Torts (Interference with Goods) Act 1977 to the addresses on file, allowing not less than three months to pay and collect, after which we may sell or dispose of the goods and apply the proceeds to the sums owed, accounting to you for any balance.

9. Ending the contract

You may end storage at any time by booking a return. We may end the contract on 30 days' notice, or immediately where goods are prohibited or payments are unpaid under clause 8.

10. Complaints and law

Email hello@boxspeed.co.uk. We reply within five working days. These terms are governed by the law of England and Wales.
